Terms & Conditions
These terms apply to everything you buy from JIGGY the store ("JIGGY", "we", "us") through jiggythestoree.com. By placing an order you agree to them. If you don't agree, don't order.
Who we are
JIGGY the store is a South African business selling premium smoking accessories. We ship within South Africa only.
Age restriction
Our products are intended for adults. By ordering you confirm that you are 18 years or older. We may cancel any order where we reasonably believe the buyer is under 18.
Orders and pricing
- All prices are in South African Rand (ZAR) and include VAT where applicable.
- An order is only confirmed once payment has been received and we have sent you a confirmation.
- We may decline or cancel an order if an item is out of stock, if a price or product description was published in error, or if we suspect fraud. If we cancel, you get a full refund of what you paid.
The product
Our accessories are sold as accessories. Nothing we sell contains cannabis, tobacco, or any controlled substance. What you choose to do with a product after you buy it is your responsibility, and you are responsible for complying with the laws that apply to you.
Our stuff stays ours
The photography, writing, designs, product design and brand marks on this site belong to JIGGY. You may not reproduce or use them commercially without our written permission.
Liability
We are responsible for supplying a product that matches its description and is free of defects. To the extent the law allows, we are not liable for indirect or consequential loss arising from the use or misuse of a product. Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008.
Governing law
These terms are governed by the laws of the Republic of South Africa.
Terms of Use
This covers how the product and the brand may be used once it's yours, and how you use this website.
How the product may not be used
JIGGY products carry our name and our marks. When you feature a JIGGY product in public, including on social media, you may not use it in content that:
- is racist, homophobic, transphobic, sexist, ableist, or otherwise hateful toward any person or group;
- harasses, bullies, threatens, or incites violence against any person or group;
- presents JIGGY as endorsing any of the above;
- depicts or encourages the sale or use of our products by anyone under 18;
- is sexually explicit content featuring our branding.
Where content featuring our branding breaches this, we may ask you to remove it, report it to the platform, and refuse to serve you in future. We may also pursue any remedy available to us for misuse of our trade marks and reputation.
Sharing your content with us
If you tag us or send us content featuring a JIGGY product, you're giving us permission to reshare it on our own channels with credit. Tell us if you'd rather we didn't and we won't.
Using this website
Don't attempt to break, scrape, overload, or gain unauthorised access to this site or any account on it.
Privacy Policy
We collect as little as we can get away with, and we don't sell it. Ever.
What we collect
- Order information: your name, email address, phone number and delivery address, so we can send you the thing you bought and tell you where it is.
- Payment information: handled by our payment provider. Card details are entered on their systems, not ours. We never see or store your full card number.
- Community sign-ups: if you join the WhatsApp community, the name and number you give us.
- Basic site data: your bag contents are stored in your own browser, not on our servers.
- Analytics: we use Google Analytics to see aggregate traffic patterns, such as which pages are visited and how people found the site. This does not identify you personally.
Why we have it
To process and deliver your order, to handle delivery queries, to respond to you, and to meet our legal and tax obligations.
Who we share it with
Only the people who need it to get your order to you: our payment provider and our courier. We also use Google Analytics to understand site traffic. We do not sell, rent or trade your personal information to anyone, for any reason.
How long we keep it
Order records are kept as long as South African tax and company law requires. Marketing contact details are kept until you ask us to remove them.
Your rights
Under the Protection of Personal Information Act (POPIA) you may ask us what personal information we hold about you, ask us to correct it, ask us to delete it, and object to us using it for marketing. Email us and we'll action it.
Marketing
We'll only send you marketing if you asked for it. Every message has a way out, and leaving the WhatsApp community is always one tap.
Delivery
We ship within South Africa only. Orders are dispatched from Cape Town.
Timeframes
Orders are packed and handed to our courier as quickly as we can after payment clears. Delivery timeframes and rates are shown at checkout before you pay, and are confirmed in your order confirmation.
Tracking
Once your order is collected by the courier we'll send you tracking details. If tracking stops updating, tell us and we'll chase it with the courier on your behalf.
Getting the address right
Please check your delivery address before you pay. If a parcel is returned or lost because the address given was incorrect or incomplete, we can't cover the cost of re-delivery.
Failed deliveries
If nobody is available to receive the parcel, the courier will follow their own re-delivery process. Repeated failed attempts may result in the parcel being returned to us.
If your order doesn't arrive
Contact us. We will open an investigation with the courier. Where a parcel is confirmed lost in transit, we will replace it or refund it in full. See Refunds.
Cancellation
The one hour window
You may cancel an online order within one (1) hour of placing it, by emailing us with your order number. Cancel inside that hour and we'll refund you in full.
After one hour your order has usually been packed and queued for the courier, and we are not able to cancel it.
If we cancel
If we cancel your order, for example because an item turns out to be unavailable, we will tell you and refund you in full.
South African law gives online shoppers rights that sit alongside this policy and that we can't sign away. Under section 44 of the Electronic Communications and Transactions Act, consumers who buy goods electronically may cancel the transaction without reason and without penalty within 7 days of delivery, and receive a refund of the price paid (you may be responsible for the cost of returning the goods). The Consumer Protection Act also gives you the right to return goods that are defective or not as described.
Where the law gives you a stronger right than this policy, the law wins. Contact us and we will honour it.
Refunds
Our position
Our products are a one time purchase and are sold as described and photographed. We do not offer change of mind refunds or exchanges once an order is on its way to you.
When we will refund you
- Your order never arrives. Tell us and we'll open an investigation with the courier. If the parcel is confirmed lost, you get a replacement or a full refund, your choice.
- Your order arrives damaged or faulty. Send us a photograph within 7 days of delivery and we'll repair, replace or refund it.
- You received the wrong item. We'll get the right one to you and cover the return.
- You cancelled within the one hour window, or we cancelled your order.
How refunds are paid
Approved refunds are paid back to the original payment method. Your bank sets the timing on their side.
This policy does not override the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002. Those give you, among other things, a 7 day cooling off right on goods bought online and a 6 month right to return goods that are defective, unsafe, or not as described. Where the law gives you a stronger right than this policy, the law applies.
